Just found out RE: Play is available thru on-demand printing via the "new" TokyoPop/RightStuf. This would be why Stu wasn't about to give me the rights to post it up for free. Sneaky, sneaky, I even emailed him before the holidays and he made no mention of my book going up for on-demand printing.

Please don't buy them. Buying them won't help me at all, I won't see a dime from them and any sales will just make my property seem like it has some money in it which will make it ever harder to ever get my property back.

If you never bought RE: Play and wanted it, please just buy something off my online store instead. There are tonnes of comics on there too:

Or hold on to your money and help support Dire Hearts, my new project that'll be up for Kickstarter later this year.
OR if you need comics now, please support another self published comicker or pick up some lesser loved titles from publishers that may not get the mainstream support Naruto and One Piece gets.

Just ugh, don't spend a dime on an on demand comic unless the proceeds go to the artist. Anyone can make an on demand book on their own thru sites like Lulu and such, don't waste your money on a "publishing company" that doesn't actually PUBLISH a dang thing.

I'll make sure not to buy anything from TP, that's really disrespectful to their artists. :hmm: Besides, a lot of their cancelled titles have been snapped up by other publishers already so I don't really know how they're planning on making a return and getting licenses back.

That sucks. I knew something was fishy about the whole 'we'll own the copyright of your work' clause in the Rising Stars of Manga and was going to enter it with something I know I won't be attached to because they were going to keep the copyrights for it anyway.

I really do hope there is some way to get your work back. I remember reading your journal posts about how much you worked on it. I seriously wish Stu goes broke because all of those artists' work he screwed him out of to line his pockets.

It's was pretty much one of the silver linings that Tokyopop going under was a good thing.

I have a curiosity question: is there any clause in the contract that allows the control of the rights to expire if the property isn't actually sold, or are you stuck until TP decides to relinquish control themselves?

I'm just curious because I used to work on a student publication that actually used contracts for the art and stories printed in it, and our contracts stated that if the piece in question wasn't actually printed within a year or two of us acquiring it, then the creator got the full rights back. So I was just wondering if you had something similar.

Regardless, this stinks, and good on you for trying to be the better person. Good luck!

Ah no, it's not bound by a time frame, as long as TP exists they will continue to hold their control over the property. A lot of small press comic companies will allow properties to time out and revert back to their creators if the publishing company is no longer selling the property, but TP isn't one of those types of companies unfortunatley.

It's shameful how much this guy is not only holding on to your copyrights with an iron fist, but is also dragging Tokyopop's name through the mud in doing so. I know he does have the rights, but surely he should have at least asked you whether it was okay to do this?

...I'm probably being very naive and idealistic here, huh. :( I really do hope you get your rights back someday...I really enjoyed RE: Play and to think you're not actually getting any payment for your own work is, well, pretty disgusting.

Well one of the big problems with TP has always been the poor way they treated their employees and creators. So informing the creators of the way their properties are being used I dont think ever really entered into the way the company was run, it's sad, but it's not surprising :(

It's kind of a grey area, after these prints sell out on my store I probably won't reprint them or ever draw new RE prints because of that fact.

Royalties, i.e. the money they pay you when something of yours sells, can vary drastically depending upon the contract. In my case the contract with TP had such a high sell thru, the total amount of revenue and books needed to sell before I see any royalties, that I will probably never see any now that the book is out of print and no longer available in stores.

Ah ha! If you need volume one, you can totally buy that direct from me! I have tonnes of volume 1 but none of 2 and 3 left XD And hey, if you buy from me I'll draw in the cover for ya ;)

And yeah any of my old books sold on Amazon are all used since they're all out of print, so I don't see any of that either. BUT if you have to buy online, def. buy used from Amazon instead of thru this on demand non sense please :) Because at least with used copies it's going to someone who legit did buy the books at one point :)

I don't have all of the issues left, I only have a few copies of random issues thru out the run. I'll be putting them up on my store in the near future, but they're very out of print and very rare so they may be kind of expensive to anyone not a collector lol.

Hang in there! That's completely shit. I really don't understand how this is all legal, but since it is... I hope you get the all the rights back. I always wished I could have seen what you were intending for the story. I know that revisiting the story would be time consuming, but I hope you do at your leisure. :)

Ah, thanks, but I already know what my contract states. They control the property, we may have half of it, but we can't legally act on our own properties w/o TP's say so. Which is why I had to ask Stu if I could post up RE for free download and why he was able to say No. Having partial rights is useless if you can't act on your own property of free will. It's essentially a worthless stake in a company. Like if you own a share of McDonald's technically you own a part of the company, but they don't have to listen to you. It's,like he said, rather a hard situation to explain. Which is why I've pretty much given up on doing anything with RE until TP finally wants no part of it an abdicates control.

It's bad in this case because it sounds like the contract isn't on a per-sale basis. Also the less profitable an asset is to a company the more inclined they are to sell it, so basically if it makes them money they'll want to keep it if not they'd rather sell the rights off.

It's really not worth it to risk it to me. I contacted Stu about it and he said no, so that was pretty much the end of it to me. I know he thinks the property still has value, but it's been missing from the bookshelf for so long I really think the only people who are interested in it are people who like my work and people who have nostalgia for the series. I don't see any new readers coming in thru it when it's not even for sale in bookstores or free on the web (which is why I wanted to put it up for free download but Stu said no so...)

Loved RE: Play and have all 3 books from way back when, also I've supported several Kickstarters (some still not done funding yet) would love to see yours when it is up and running, can you tell us a little more about what it is going to be? Like usually Kickstarters are for games, but I mean what type or whatnot?

Ah, I've only ever seen games on KS then XD. And ah okay, does that mean that you'll have like stretch goal stuff and throwing ideas in and whatnot. Or some type of like... various levels of funding with rewards associated therein?

Yeah, my husband and I recently pitched in for a KS for a webcomic that was intended to get all their previous compilation books reprinted (because previously they were all limited run by necessity rather than choice). Lots of things besides games get Kickstarters.

Um...yes? It'll be a pretty standard KS campaign? You can go to the KS site and see what other people do for comics projects, it's it's own category and theres usually like 60-90 comics projects on there, usually more than games, at any given time.
